Hiring a foreign national employee differs significantly from hiring a U.S. citizen, and requires the hiring department to obtain an employment-based visa before the individual can work in the U.S. The information in this section applies to hiring foreign nationals only. Immigration Services will work with employees and hiring departments to navigate this and other processes.
Hiring departments will be responsible for paying employment visa filing fees for the foreign national employee, specifically, H-1B and I-140 petitions. Filling fees must not be passed on to the foreign national employee.

To work in a specialty occupation, requires a higher education degree or its equivalent. This includes fashion models of distinguised merit and ability and government-to-government research and development, or co-production projects administers by the Department of Defense.

Michigan Tech University assists with the Employment-Based Immigration: Second Preference EB2 Special handling Process. If the employee wishes to apply for a green card using the National Interest Waiver or Extraordinary Ability/Outstanding Researcher or Professor process, approval from the dean and chair of the hiring department is required.
Attorney fees, these costs may be covered by employee, department and or school/college with these types of petitions. Please call Immigration Services to obtain attorney fees which are subject to change.
Employment-Based Immigration: Second Preference EB-2
You may be eligible for an employment-based, second preference visa if you are a member of the professions holding an advanced degree or its equivalent, or a foreign national who has exceptional ability. For categories and requirements visit the U.S. Department of Homeland Security website.

Employment-Based Immigration: First Preference EB-1
You may be eligible for an employment-based, first preference visa if you have an extraordinary ability, are an outstanding professor or researcher, or are a multinational executive or manager. Michigan Tech has retained an attorney to assist with EB-1 petitions. Each occupational category has certain requirements that must be met.
