                        Outside contractors working on campus are required to have an up-to-date certificate
                              of insurance on file with Engineering Services and an approved Contractor Pre-Qualification Form for their bids to be considered.

                                    Michigan’s Prevailing Wage Act (Act 10 of 2023) takes effect on Tuesday, February
                                       13, 2024.  This will impact all posted bids for projects at Michigan Technological
                                       University. Prevailing wage rates will be posted as an Addendum for each University project put
                                          out for bid.  Under the Michigan law Prevailing Wages on State Projects, MCL 408.1101 et seq., rates
                                       of wages and fringe benefits to be paid to each class of construction mechanics employed
                                       by the contractor and all subcontractors shall be not less than the wage and fringe
                                       benefit rates prevailing in the locality in which the work is to be performed.  
                                    
                                    Prior to bidding on covered projects, every contractor and subcontractor shall register
                                       with the State of Michigan annually. MCL 408.1102a.  Every contractor and subcontractor
                                       shall keep posted on the construction site, in a conspicuous place, a copy of all
                                       prevailing wage and fringe benefit rates prescribed in a contract and shall keep an
                                       accurate record showing the name and occupation of and the actual wages and benefits
                                       paid to each construction mechanic employed by it in connection with said contract.
                                       This record shall be available for reasonable inspection by the contracting agent
                                       or the commissioner.  MCL 408.1105.  Contracting agents, contractors, and subcontractors
                                       shall maintain certified payroll records and other records required under this act
                                       for a minimum of 3 years. 
                                    
                                    Contractors and subcontractors shall submit certified payroll records electronically
                                       to the state database.  MCL 408.1122.  A contractor or subcontractor shall not discharge,
                                       discipline, retaliate against, or otherwise discriminate against a construction mechanic,
                                       or threaten to do any of these things, because the construction mechanic reported
                                       or was about to report a violation or suspected violation of this act.  MCL 408.1107. 
                                       Each contractor or subcontractor is separately liable for the payment of the prevailing
                                       rate to its employees.  See MCL 408.1108(2).   In addition to any other penalty provided
                                       by law, the commissioner may assess a civil penalty of not more than $5,000.00 for
                                       each violation of this act and an additional 10% penalty as determined by the commissioner. 
                                       MCL 408.1113(1).Construction mechanics are intended beneficiaries of the contractual
                                       prevailing wage, fringe benefit, and nondiscrimination nonretaliation requirements
                                       of the Michigan law Prevailing Wages on State Projects, MCL 408.1101 et seq.  Any
                                       construction mechanic aggrieved by the failure of a contractor or subcontractor to
                                       pay prevailing wages or benefits as specified in the contract, or by a violation of
                                       section 7, in addition to any other remedies provided in this act or by law, may bring
                                       an action in a court of competent jurisdiction against the contractor or subcontractor
                                       for damages or injunctive relief and may be awarded reinstatement or other appropriate
                                       relief, and all damages sustained, together with actual costs and attorney fees at
                                       trial and on appeal.  MCL 408.1112.Please contact Facilities Management Planning and

                                       effectiveness to the process of soliciting bids for construction projects. It brings
                                       everyone the information they need in a timely, convenient, cost effective and easy
                                       to use way.
                                    
                                    Plans may be viewed at this site for free, however downloading the documents requires
                                       registration and a $22.00 fee. The digital project plans will be provided in the easy to use Adobe PDF format, so
                                       there is no software investment required. All you need is internet access.  If you
                                       do not already have Adobe Acrobat Reader available, the QuestCDN.com web site has
                                       a link for you to follow to assist you in downloading this free software. You will
                                       be able to print just the pages you need. While we realize printing capabilities vary
                                       in our industry, many of you already have the access to print larger formats than
                                       8 ½ x 11. If you do not have this capability in-house currently, please contact Facilities
